Terms and Conditions

1. Introduction

Welcome to the American Samoa Department of Health Passenger Travel Health Portal ("Portal"). This Portal is operated by the American Samoa Department of Health ("DOH", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Portal, including any related services, features, content, and functionality.

By accessing or using the Portal, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Portal.

2. Acceptance of Terms

By creating an account, submitting a health declaration, or otherwise using our Portal, you confirm that:

  • You have read and understood these Terms;
  • You agree to be bound by these Terms;
  • You are legally capable of entering into a binding agreement;
  • You are at least 18 years of age, or if you are under 18, you have obtained parental or guardian consent to use the Portal;
  • You will use the Portal in accordance with these Terms.

If you are using the Portal on behalf of an organization, entity, or individual other than yourself, you represent and warrant that you are authorized to accept these Terms on their behalf.

3. Eligibility and Registration

To use certain features of the Portal, you may be required to register and create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information;
  • Maintain and promptly update your account information;
  • Keep your account credentials secure and confidential;
  • Be solely responsible for all activities that occur under your account.

We reserve the right to suspend or terminate your account if any information provided during registration or thereafter is determined to be false, inaccurate, or incomplete, or if you have violated these Terms.

4. Health Declaration

The primary purpose of this Portal is to collect health declarations from passengers traveling to American Samoa. By submitting a health declaration, you:

  • Certify that all information provided is truthful, accurate, and complete to the best of your knowledge;
  • Acknowledge that providing false, misleading, or incomplete information may result in denied entry, legal penalties, or other consequences as determined by applicable laws and regulations;
  • Understand that completion of a health declaration does not guarantee approval or entry into American Samoa;
  • Consent to verification of the information provided through appropriate channels;
  • Agree to comply with any additional health screening, testing, or quarantine requirements upon arrival as determined by health authorities.

5. Privacy and Data Use

Your privacy is important to us. Our collection and use of your personal and health information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Portal, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

You acknowledge and understand that:

  • The information collected may be shared with relevant health authorities, immigration officials, and other government agencies as necessary for public health and border control purposes;
  • Your information may be retained for legal, public health, and record-keeping purposes in accordance with applicable regulations;
  • De-identified or aggregated data derived from Portal submissions may be used for public health research, statistical analysis, and policy development.

6. Limitation of Liability

To the fullest extent permitted by applicable law, the American Samoa Department of Health and its officials, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your access to or use of, or inability to access or use, the Portal;
  • Any delays or disruptions in the Portal's functionality;
  • Any decisions made or actions taken by you or any third party based on information obtained from the Portal;
  • Unauthorized access, use, or alteration of your transmissions or content;
  • System failures, interruptions, or downtime of the Portal.

The Portal is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Indemnification

You agree to defend, indemnify, and hold harmless the American Samoa Department of Health, its officials, employees, agents, and contractors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Portal;
  • Your violation of any term of these Terms;
  • Your violation of any third-party right, including without limitation any privacy right or intellectual property right;
  • Your violation of any applicable law, rule, or regulation;
  • Any claim that information submitted by you caused damage to a third party.

This defense and indemnification obligation will survive these Terms and your use of the Portal.

8. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Portal after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Portal.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of American Samoa, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts of American Samoa.
